Terms of Use for Coya's Customer Account
These terms and conditions apply to access and use of an online customer account (from here on "customer account" or "dashboard") with Coya AG (hereinafter referred to as "Coya"), accessible at www.coya.com and app.coya.com/application/dashboard.
The customer account and any insurance contracts with Coya exist independently of each other, so that the termination of an insurance contract does not automatically lead to the deletion of the customer account.
These Terms of Use govern exclusively the opening and use of the customer account. For other Coya products, in particular insurance contracts, the respective valid insurance conditions apply.
Contract closing and opening of a dashboard
1.1 Coya offers the possibility to activate and use a dashboard. It should enable you to digitally manage your Coya insurances. The activation of the dashboard is done during the purchase process, but is also possible independently from the conclusion of an insurance contract with Coya.
1.2 To activate the dashboard, you will need to enter your email address and create a password. You will be asked to do this during the purchase process on our website. By entering these data and clicking “create account” you accept these terms of use.
1.3 You will then need to verify your email address by clicking on the link in the verification email that was sent to you. With successful verification a contract of use is concluded between you and Coya.
1.4 Please note, however, that there is no legal claim to the closing of the contract of use against Coya. In particular, Coya may refuse the conclusion of a contract of use or deactivate an existing customer account if it suspects untrue user data or breaches of contractual or fiduciary duties. A deactivation of the customer account is equivalent to a termination of the contract of use.
Functions in the dashboard
2.1 The dashboard has the following functions:
- You can view your active insurance contracts and download your contract documents via the dashboard.
- You can report claims via the dashboard.
- You can use the dashboard to view the insurance products on offer and conclude insurance contracts. You can also see insurance products that will be available in the future.
- You can change and customize your insurance coverage in the dashboard.
- You can view and partially change your personal information, password and payment details. As a Coya customer you are obliged to keep your personal information up to date.
- The dashboard gives you access to special offers from Coya (e.g. links to the refer-a-friend program, discounts, etc.).
2.2 Coya reserves the right to make changes, restrictions and extensions of the scope of functions of the dashboard. The current version of these terms of use can be viewed at any time at www.coya.com/more-legal-info/customer-account.

Marketing communications and e-mail notifications
3.1 Users of the Coya Dashboard receive notifications about Coya's product range (marketing messages). We will only send marketing messages that are directly related to Coya's insurance offer. This is based on Coya's legitimate interest (Art. 6 para. 1 lit. f DSGVO) as a young company to keep its customers and account users informed about the expanding range of insurance products.
3.2 Marketing communications can be unsubscribed by clicking on the "unsubscribe" button provided in each email or by sending an email to hello@coya.com.
Ban on multiple customer accounts
4.1 You may only maintain one customer account and must refrain from creating an additional customer account if you already maintain one.
4.2 The information you provide (especially, but not exclusively, about yourself, your name, means of payment, address, etc.) must be complete and true. Coya reserves the right to request proof of identity from you in individual cases. For this purpose it may be necessary that you send us a copy of your identity card. You agree to update your data in case of changes.
4.3 If you maintain more than one customer account, Coya is entitled to merge or deactivate or block these accounts. A deactivation or blocking of the account is equivalent to a termination of the contract of use.
4.4 If Coya incurs expenses because we had to merge or deactivate/block accounts because you created multiple customer accounts, we can charge you for these expenses.
4.5 If due to an error (e.g. typing error) or by mistake there are multiple accounts in your name and you inform us within 72 hours of creating the account, 4.4 will not apply.
Your rights and obligations in connection with this user agreement
5.1 You are entitled to access the dashboard at any time and use the functions listed under 2.
5.2 No fee is charged for opening and using the dashboard.
5.3 An existing Internet connection is required to use the dashboard. Coya does not reimburse you for the cost of your internet connection.
5.4 In your own interest, please protect your password and access to the dashboard from unauthorized access or use. Do not share your password with third parties. Choose a secure password with at least eight characters, an upper and lower case letter, a number and a special character.
5.5 If you become aware or suspect that someone is using your dashboard without permission, change your password and notify Coya (hello@coya.com).
5.6 Any misuse of the dashboard is prohibited.
In particular, it is prohibited to bypass Coya's technical security measures and to manipulate, use, abuse, alter or damage Coya's information technology systems without authorization. The installation, reprogramming or spreading of Trojans, viruses and other malware via and on Coyas information technology systems is prohibited and shall be omitted.
It is also prohibited to create a customer account with the intention of harming a third party.Rights and obligations of Coya
6.1 Coya agrees to provide you with the ability to use and access the dashboard at any time. Coya grants you a limited, non-exclusive, non-transferable, non-sublicensable right to use the dashboard.
6.2 In exceptional cases, functionality and access to the dashboard may be limited or impossible. This applies in particular to cases of force majeure and other hindrances, due to which the provision of the dashboard is temporarily not possible or not without disruption. Coya will use reasonable and justifiable efforts to restore the provision and functionality of the dashboard.
6.3 If you breach any of the obligations under this agreement, Coya reserves the right to terminate this user agreement and block further access to the dashboard.
Term and termination
7.1 This agreement is concluded for an indefinite period and runs independently of your insurance contract. The agreement does not automatically end with the termination of your Coya insurance contract.
7.2 If you have no active Coya insurance contracts, you can cancel this agreement. To do so, click on the button "delete my account", which is displayed in the dashboard. Coya will then deactivate the dashboard. There is no notice period and you do not need to give any reasons for termination. Alternatively, you can cancel your account by e-mail (hello@coya.com) or by phone (+ 49 30 588 49400).
Liability
8.1 Any liability of Coya for the activation and use of the dashboard is excluded, except for the following provisions.
8.2 The exclusion of liability in 8.1 shall not apply to the following cases:
- Coya shall be liable without limitation for damages due to injury to life, body or health if such injury was caused by a negligent or intentional breach of duty by Coya, its legal representatives or agents.
- Coya shall be liable without limitation for injuries and damages to other legal assets if the injury or damage is based on a grossly negligent or intentional breach of duty by Coya, its legal representatives or vicarious agents.
- Liability for violations of and damage to other legal interests also exists if it concerns an obligation whose proper fulfilment serves the proper execution of the contract and on whose compliance the other party may regularly rely (so-called cardinal obligations).
- Furthermore, the exclusion of liability in 8.1 does not extend to claims from product liability or claims from the German Insurance Contract Act.
- Coya shall be liable without limitation for damages due to injury to life, body or health if such injury was caused by a negligent or intentional breach of duty by Coya, its legal representatives or agents.
Data protection
Our privacy policy applies to the processing of your customer account data. You can access this at www.coya.com/privacy-policy. You will find the relevant data protection information under the item order processing and customer account ("dashboard").
Final provisions
10.1 This contract of use is subject to German law to the exclusion of private international law.
10.2 There are no further agreements.
10.3 Agreements in connection with this agreement require the text form.
10.4 Should one of the above clauses be invalid, this shall not affect the validity of the remaining provisions.
